Your Consumer Guide to Collision Repair

Many times when someone has had an accident, they think ,“The insurance company will take care of it for me.” In fact, it is your right and responsibility to make a decision on whom to choose to repair your vehicle. This is a choice that should not be taken lightly, as your decision involves protecting a major investment.
You have the right to decide at which shop you have your vehicle repaired, according to the Office of  the Treasurer, Department of Insurance, and Bureau of Consumer Assistance.
Below are answers to the most common misconceptions people may have:
Misconception #1: My agent says I have to use XYZ Auto Body; they are on the insurance company's “approved list of repair shops.”
ANSWER: NO, YOU DON’T. This is called steering — this means that your insurance company is trying to dictate where you have your vehicle repaired — THIS IS ILLEGAL! Anyone can suggest to you where to take your vehicle. However, no one can tell you that you must have your vehicle repaired in a specific shop. Freedom of choice is your inalienable right ... do not give it up!
Misconception #2: My insurance company says if I take my vehicle to a shop other than those on their lists, they cannot guarantee the work — indicating that a non-preferred shop may not complete the repairs properly.
ANSWER: ABSOLUTELY FALSE. Consider this — the only thing an insurer can guarantee is to pay the bill. The body shop exists as a separate entity and is totally responsible to fully guarantee those repairs to your vehicle. Once a repair facility works directly for the insurance company, the insurance company becomes the repair facility's boss. You, the vehicle owner, have little say, if any, on the repair process. Know that all repair facilities must meet county and licensing standards, and all body shops must offer a full guarantee on all repairs. For an insurance company to say they guarantee repairs is known as a conflict of interest and, again, is not possible or legal. Once you choose an independent shop that meets all the criteria for quality workmanship, they will work for you while dealing professionally — on your behalf — with the insurance company. It is in the best interest of the independent repairer to give you 100% service and satisfaction. After all, without your recommendation, he cannot stay in business.
Misconception #3: The shop that wrote the lowest estimate is the one my insurance company says I should use.
ANSWER: NO WAY. Never go with the lowest estimate — you have to ask yourself, “What did they miss or leave off to make the estimate lower?” There are those shops and insurance companies that write low estimates on purpose. For the insurance company, it is simply a cost-saving device. For some of these shops writing these low estimates (often missing quite visible and obvious damage) is done to get work in the door. Once the job is in, suddenly there is a large list of damages, which is added to your bill, and you or your insurance company are charged accordingly.
Misconception #4: My insurance company is looking out for my best interest.
ANSWER: IF IT SEEMS TOO GOOD TO BE TRUE — IT PROBABLY IS. All of us know that we have to look out for our own interests, and by making our own choices, we usually will make the right decisions — to hand over our rights to any institution (no matter how clever the advertising is) diminishes and takes another chunk out of our freedom. After all, the choice is yours.

There is nothing in the Florida law to prevent insurance companies from having “selected” body shops. However, the insurance company cannot  tell the customer that they must  have the work done at a certain shop. You, the consumer, have the right to choose.
